New IRS Forms W-8IMY and W-8BEN-E Released

The IRS (Internal Review Service), the agency of the Treasury Department that is responsible for tax collection in the United States, recently released the new Forms W-8IMY and W-8BEN-E.
The Agency is dedicated to providing quality service to American taxpayers, helping them understand and fulfill their tax responsibilities and apply the law.
In July the forms were revised W-8IMY – Certificate of Foreign Intermediary, Foreign Flow-Through Entity, or Certain US Branches for United States Tax Withholding and Reporting e W-8BEN-E – Certificate of Entities Status of Beneficial Owner for United States Tax Withholding and Reporting (Entities).
The W-8IMY includes certifications for Qualified Derivative Dealers and modifies the certifications for sponsored FFIs (Foreign Financial Institutions) to reflect regulatory changes requiring them to acquire their own GIIN (Global Intermediary Identification Number). Additionally, the certifications regarding primary withholding responsibility and reporting for QIs (Qualified Intermediaries) contained in Part III have been simplified.
The new W-8BEN-E, however, provides that certifications for sponsored FFIs no longer require the indication of the GIIN of the sponsoring entity and certification for nonreporting IGA (Intergovernmental Agreement) FFIs.
