The National Recovery and Resilience Plan (NRRP) represents a fundamental pillar for Italy's future, in a period marked by profound changes and unprecedented challenges.
In this context, the Next Generation EU program plays a key role in accelerating economic recovery. However, the complexity and scale of these initiatives require scrupulous oversight and rigorous controls to prevent potential financial abuse and ensure ethical management and compliance with AML (Anti-Money Laundering) regulations.
Our course on AML Controls for the PNRR, aimed at Public Administrations, is designed to provide a comprehensive understanding of the principles and practices necessary to ensure that PNRR-related activities are conducted legally, ethically, and in full compliance with AML regulations.
Structure
The course on AML Controls on the PNRR intended for Financial Intermediaries is structured in two parts:
PART 1
Context: We will examine the importance of the PNRR as a key opportunity for Italy's future, in a context of profound and unprecedented economic and social change. We will also delve into the crucial role played by the Next Generation EU Programme in promoting economic growth.
UIF Communications: During the course, we will delve into the communications issued by the Financial Intelligence Unit (UIF). These communications form the essential foundation for understanding and applying AML controls. We will analyze in detail the Provision of April 23, 2018, regarding reports from Public Administrations, the Communication of April 16, 2020 in response to the COVID emergency, the tax crime schemes dated November 10, 2020, and subsequent communications.
PART 2
The Fundamentals of the Reporting Obligation Applied to PNRR Issues:
From the Predicate Offence to Customer Knowledge, to the Obligation to Abstain, to Continuous and Constant Monitoring, to the Communication of data and information concerning suspicious transactions, to Anomaly Indicators, to the methods and terms of communication, to the role of the Manager and the related organizational structure, to the confidentiality and conservation obligations.
Relationship with the UIF and Access by the GdF or the DIA: We will discuss how to effectively manage relationships with the Financial Intelligence Unit (UIF) and address access by the Guardia di Finanza (GdF) or the Anti-Mafia Investigation Directorate (DIA). Anomaly Indicators: We will examine in depth the indicators related to the identity or behavior of the entity to whom the transaction refers, the methods of requesting or executing transactions, and specific indicators for sectors such as procurement, public contracts, public funding, real estate, and commerce.
Practical Cases: To consolidate understanding, we will address practical cases based on real situations, allowing participants to effectively apply the knowledge acquired in the management of activities related to the PNRR.
