We will analyze them in detail on May 22nd, as part of the specific module on anomaly indicators and patterns of anomalous behavior, included in the Anti-Money Laundering & CFT Master's program at the Italian Anti-Money Laundering & Compliance School.
As we know, the anomaly indicators, provided for by Legislative Decree 231/2007, are important tools for identifying suspicious transactions and play a fundamental role in guiding obligated entities in assessing transactions.
There are 34 anomaly indicators, each divided into sub-indices, which are examples of the reference indicator. Indicators 1 to 8 (section A) highlight profiles that pertain to the behavior or qualifying characteristics of the entity to which the operation refers; indicators 9 to 32 (section B) concern the characteristics and configuration of the operation, including in relation to specific sectors of activity; indicators 33 and 34 (section C) pertain to operations that could be connected to the financing of terrorism and programs for the proliferation of weapons of mass destruction.
Among the new elements are indicators regarding the direct or indirect involvement of PEPs and public entities or entities with public purposes. Also highlighted are the anomalies associated with the use of crypto-assets, the sale or purchase of receivables, or the transfer of assets in bankruptcy proceedings or as collateral for receivables, as well as anomalies in the use of correspondent current accounts and similar relationships.
The Provision, available on the UIF website, will be published in the Official Journal of the Italian Republic and will enter into force on January 1, 2024. From that same date, the anomaly indicators and patterns of anomalous behavior referred to in Article 7 of the Provision will no longer apply.
